Deceased, who was loading a truck of road metal at a loading bank 7 feet in height, had gone down into this truck to level this stones. A locomotive driver whistled to warn him that he was about to shunt. Deceased seated himself upon this edge of the loading bank and was swinging his legs up out of the way, when the trucks began to move, and the one next to that which his had been filling having a higher body caught one of his feet and crushed it against the face of loading bank. He died 6 days afterwards from exhaustion.
