Deceased was engaged in retimbering a level in the Red Mine near the bottom of a jig. He was cutting a nick in the deep side for a short leg to hold a bar 4 feet distant from a bar similarly supported. A fall of roof occurred over a distance of 12 feet, reeling out the last-mentioned bar and burying deceased. It is probable that in cutting the nick deceased reached a joint in the strata and so liberated the ground on the deep side of the level on which the roof was supported.
