Deceased had charge of the clay pit and was very careful to see that the face was kept in a safe condition. He sent a labourer to the top to clear away some loose clay and watched that operation from the bottom. As soon as all had been cleared to his satisfaction he told the man to come down and turned to leave when a part loosened by the previous day's rain slipped away and striking him he was thrown to the ground.
