- Deceased and his brother were chartermasters who paid all the workmen employed underground (but not the Deputy), and supplied the timber. Deceased was working in a gate-road in the Thick coal, which at this point was only 8ft. thick, the coal above the Sawyer being cut out by a thick bed of rock. At 12.45pm., the place was visited by the deputy who told deceased to clear away the lying coal and set a tree or two as soon as possible. At 2pm. deceased was still engaged in clearing away the coal when a piece of the overhanging coal, which had probably been shaken by two shots fired two hours previously came off at a slip, and dropped upon his head, killing him instantly. Had the trees which the deputy advised been set the accident would probably have been avoided but the stallman declared that they were clearing a place for the trees as quickly as they could.
