- Four loaded wagons were standing under the screen against triggers or chocks. Deceased knocked out the triggers from under the wheels and was attempting to lower them down a road, dipping 1 in 50, by means of the brake of the first wagon, when he found he could not control them, and he picked up a prop which was lying near and pushed it between the spokes of the front wheel of the first wagon, with the result that when it came against the grease box the end of the prop struck and knocked him across the rail, and the last wheel of the first wagon ran over and killed him. He had been repeatedly warned that he must not touch the wagons, and that the Coal Mines Act did not allow him to move them.
