Deceased was employed as a hookeron along with a youth at the bottom of an engine plane. While ascending the incline a set of tubs broke loose. Deceased took refuge between the timbers at the road side. Unfortunately the tubs left the rails and struck a tree against which deceased bad placed his head. The impact caused a fracture of the skull and he died on the following day. There were sufficient manholes at the bottom and along the plane less than 10 yards apart. Deceased might have entered one of them had he wished to do so.
