Deceased stepped on to a rubbish road to get out of the way of a horse which was drawing empty trains along a parallel road, and was knocked down by a tram of rubbish which was being lowered by the banksman. The banksman saw him and shouted a warning but was unable to check the speed of the tram as the rails were wet.
