While engaged removing the overburden of the quarry which consisted of stiff red clay 9 feet thick with a few stones in it deceased had undercut a length of 6 yards to a depth of from 6 to 9 inches and was so engaged when suddenly a mass of clay practically the whole height and width fell away and part of it caught him and broke his neck. The weather had been very wet.
