Deceased was attempting to replace on the rails a tram of rubbish which had left the road on a gradient of 10 inches per yard. Owing to the gradient the tram was controlled by a chain attached to the back end of the drawbar and passed twice round a post. In the operation of getting the tram on the rails, the man who was attending to the chain at the post got his fingers pinched by it and let go, with the result that the tram ran down the road for a few yards with deceased in front, and crushed him to death against a post.
