He was in a mess-house during the time shots were being fired. A stone projected by a shot for a distance of 77 yards pierced a board fence, went through the side of the mess-house, and struck him, causing injuries which resulted fatally on the same day. No one was supposed to be in the mess-house during the shot-firing, but a regulation to this effect was not rigidly enforced by the foreman.
