- Suffocated or overcome by noxious gases in an exploratory or "costeaning" pit for china clay on Dartmoor. The pit was under 17 feet in depth. Means were adopted, or thought necessary, for artificial ventilation. It seems open to question whether this is really a case under the Metalliferous Mines Act, or the Quarries Act, under which the subsequent work would be prosecuted. I think however, it comes under the definition of a mine under the Mines Act at the time of accident, and consequently treat it as such.
