Deceased was a foreman sinker at the time of the accident was engaged removing a scaffold 7 fathoms below the Great seam and the planks raised to said seam by a rope and drawn up by two workmen. A plank was fixed to the rope in the way and while being hauled up it slipped from the rope and fell striking deceased on the head. The rote had not been properly fastened by deceased.
