- Deceased was working in an opening in the top section of the Thick Coal. On the day prior to the accident the ‘Spires’ had been got down over a portion of the opening and three trees put up. The coal was being filled and deceased was throwing the coal back to the loader when suddenly the roof fell reeling out the three trees and burying deceased, who was dead when extricated 15 minutes later. The fall was about 12 feet long, and 6 feet wide at base tapering out to nothing at a point 6 feet high; it consisted of coal 18 inches thick and then batt and clod, and came off at a break running along the rib side. The roof had been examined just before the fall slid it was considered safe.
