Deceased and another man were engaged in timbering a main road, and had placed an 8-foot bar in position against the roof The bar was supported by two props, one in the middle and the other at one end. The deceased mans mate was measuring the required length of a third prop by placing it in an upright position against the bar, when a fall of dirt occurred and caught the foot of the prop, causing it to fall over and strike him on the shoulder. He pushed the prop away in order to free himself and it caught deceased in the stomach, causing injuries which were at first thought to be slight but which terminated fatally on 18th June.
