Deceased had been levelling nuts on the top of a full waggon at the screens, when three empties which had got out of hand while being lowered to the screens bumped into it. Deceased was knocked down and fell to the ground. The shunter who let the waggons down gave no actual warning to deceased, as the latter was standing on the platform out of the waggon when the shunter passed him a few moments previously. The accident was due to a contravention of, No.14 of the Special Rules for Colliery Sidings, for which the shunter was by agreement fined in £1.
