- Deceased and his marrow were hewing together in a jenkin or lift 16 feet wide in broken workings in the Main Coal Seam, which is made up of 4 feet of top coal, 4 inches of band and 3 feet of bottom coal. The bottom coal and band had been taken out for 13 feet across the place from the loose side to a depth of 13 feet. One stay was set to support the top coal and a shot was ready to bring it down. While deceased was filling a tub a length of 5 feet fell away from the loose side displacing the stay and he was struck and fatally injured. The coal came away from a brassy cleat. More stays should have been set, and there was suitable timber close by. The deputy had visited the place three hours before the accident. The local Inspectors reported, ‘we consider that the place was in a safe and satisfactory condition, and as far as we personally knew the deceased he was a very careful workman.’
