- He was holing a piece of coal which had a loose side, and in addition there was a break 2.5 ft. from and parallel to the loose side. Notwithstanding this he neglected to set a sprag, and while working the coal fell upon and fatally injured him. The collier in the place did not, as he should have done, see that the deceased who was his trammer, who was complying with the Special Rules and working in safety. Proceedings were taken against him and he was fined 40s. and 15s 6d. costs.
