A haulier, acting under deceased’s instructions was letting a journey of 16 full trams, controlled by sprags only, down the parting towards the shaft. Two full trams, part of a previous journey, stood on the same road, and between them and the shaft a horse was pulling four trams of stones and mortar through a back parting into the empty road. The journey blocked against the two trams, and squeezed deceased between the leading tram and the side of one of the trams of stone which he was trying to push clear. It was an accident that might have been avoided by the exercise of greater care by all concerned. Deceased was in charge of the operations.
