While riding inbye in an empty tram and having reached the double parting the catch or devil (which was out of order) caught the axle of the fourth tram causing the shackle between it and the third to break the strain upon the rope caused by the load or journey being thus relieved the trams sprang forward and jerked Jones against the roof causing injuries from which he is alleged to have died.
