An empty tram and a tram loaded with timbers were being drawn by a horse along a heading rising slightly deceased and his assistant were following. When they had proceeded 200 yards, the hook coupling the trams rose, and the tram laden with timber ran back caught deceased as he was stooping to pick up a stone lying on the road and ran over him.
