Deceased was in charge of the pit top and on night duty at the time of the accident. He took a full tub out of the cage, closed the gate and took the tub to the weighing machine, he then returned to the shaft to put an empty tub into the cage and in doing so opened the wrong gate and pushed the tub in at the side where there was no cage and he and it fell to the bottom of the shaft, a distance of 140 yards. There was a good light and it is difficult to account for his having opened the wrong gate; he must have done it in a moment of forgetfulness.
