- His ordinary occupation was to fill the coal cut by the coal-cutting machine but there being no coal cut he had as is usual in such case, been set on to hew. The place they were in was examined by the deputy at 5.30am. He went into it at 6.40am. and the accident occurred at 8.15am. The place had been well timbered, but a stone fell from the roof between the timber and the face. Over the stone there was a coal pipe and the top of the stone itself was highly polished and could have had no adhesion to the coal pipe. He had jowled the stone just before it fell.
