- Deceased was a pony putter or trailer in longwall workings in the Metal band. He had taken a loaded tub from and when about 90 yards from the face, had been behind the tub when a fall of roof occurred and completely buried him. The fall came away from a damp greasy slip running diagonally across the road. The stone was 4 feet by 2 feet 3 inches and 14 inches thick. No timber had been set under it. The undermanager passed the pony and tub and the fall 10 yards further in-bye but was not aware deceased was under it but thought he had gone for the deputy and it was not until he had some conversation with the hewer deceased had left that he suspected deceased was under the fall. The place where the fall occurred was rather lower than other parts of the road but when examined by the deputy before work commenced was considered by him to be safe. At the inquest the deputy stated he had not sufficient time to examine all the places in his district within the two hours, fixed by Special Rule, before work started. The Jury were under a slight misapprehension as to the meaning of the evidence that the place where the fall occurred was low, they seemed to think this meant it was dangerous and in their verdict they censured the deputy for not remedying it, a censure that in my opinion was not deserved.
