Two hauliers unscotched a tram on a steep gradient and allowed it to run wild notwithstanding that they were told not to meddle with it ran into a door at which deceased was stationed and killed him. They were subsequently prosecuted under the Coal Mines Regulation Act and sent to prison for one month by the Justices, without the option of a fine.
