- Deceased was repairing an old airway to form a travelling road. At the place of accident there were two low girders, above which was about 4 to 5 feet of loose ground up to a good strong roof, and the sides were more or less arched. Deceased was instructed to take out the dirt from over these girders and then remove these, but after moving part of the dirt he cut out the tree supporting one end of the first girder when the girder lowered, followed shortly afterwards by a rate of rock from the side which struck deceased and fractured his neck. The rate had been liberated at one end by the moving of the girder, and at the other and came off at a small slip.
