Deceased who had worked 18 months in the pit, was driving a set of 9 loaded tubs outbye on a level road 12 feet wide and 12 feet high and laid with rails weighing 40lbs. to the yard. He was last seen sitting on the limbers as he passed a stoneman about half an hour before he was found dead by the putter, who had come out from the flat to ascertain why he had not returned with the empties. The pony was lying down with its limbers still connected to the first tub and deceased’s head was between the limbers and tub and be was quite dead. The two leading tubs were off the way his safety lamp was near his body. There was nothing observed in the shape of a fall of roof or other cause to account for the tubs being derailed and it is probable that the pony had stumbled and fallen and so caused the accident. The Local Inspectors reported ‘In our opinion it is a pure accident.’
