- Deceased and another were tipping debris from a side-tipping wagon at the end of a spoil heap. The rails were laid right up to the end or the tip and were guarded by a stop-block, which his mate stated they bad been instructed never to remove. The wagon was pushed up against the stopblock and tipped, but part of the debris did not fall out. Deceased then removed the stop-block and pulled the wagon nearer to the end of the rails, when all the debris fell out with the exception of two stones. The body of the wagon was then restored to its normal position and fastened to the frame, when deceased jumped on to the end of the frame and leaned over into the wagon in order to throw the stones out. His weight appears to have set the wagon in motion and it moved forward over the rail end, throwing him over the tip. He fell a distance of about 10 feet and the wagon followed and fell upon him, causing injuries which resulted fatally threequarters of an hour afterwards.
