- Deceased was engaged in trailing bogies of rubbish from No.10 Company's drift and tipping them in an abandoned working about 150 yards distant The floor of the old working in which the debris was being deposited was 8 or 10 feet lower than the level of No.10 company’s drift. On the morning of the accident deceased had laid a length of rails which projected slightly beyond the end of the rubbish heap. He was alone when the accident happened but he had apparently tipped his bogie and walked round to the front to clean it out, and, at that moment, a slight subsidence of the end of the rubbish heap caused the bogie to roll over on to him. When found he was under the bogie, which contained several large stones tightly jammed together.
