- Deceased was driving a set of 4 loaded tubs out-bye on a road inclining in favour of the load and laid with double way. Two drags were put in at different points and he was last seen walking by the side of the tubs after having put in his second drag. The next driver coming out observed deceased lying between the rails with a leg over the full way, which he was able to push aside as he sat on the limbers. In the meantime deceased’s pony and set had gone out-bye, all the tubs being on the rails. He was unconscious and died as he was being taken to the shaft. It was supposed that in getting on to the limbers he had allowed his head to come in contact with a balk. The Local Inspectors reported, ‘We are of opinion the same was a pure accident.'
