Deceased, who was engaged in cleaning up a dip in the Red Mine where the inclination is about 1 in 6 left his assistant to push down it a load which had struck after going down 6 yards while he himself went down to push up at the empty tub attached to the other end of the jig chain. He moved the empty tub a short distance when the load started with a jerk and the chain broke. The load ran amain a distance of 16 yards and then crashed into the empty tub and caused deceased to be thrown against the side of the road with the empty tub on top of him.
