- Whilst jigging the tubs stopped near the meetings; deceased arranged with his assistant for the break to be held up whilst he went down to the tub, he thought they would be just sticking a bit in simultaneously as deceased arrived at the inbye end of the empty train the taker off from the bottom of the jig arrived at the outbye end of the empties, saw the last tub was off the rails, called to deceased should he lift the tub on the rails, was told to do so; when the empty tub was put on rails the trains started off, deceased was then in front of the empties, and before he could get clear was caught against a low bar, his head severely crushed. It was wrong to have the break off; had deceased stood behind the full tubs he would not have been hurt when they started; the low bar also contributed.
