- Deceased was engaged on the pit brow changing a fence bar or rail which was, bent. He had removed the bent rail and was replacing it with a straight rail when apparently it slipped and jerked him into the pit. There were two rails forming the fence, and the top rail was in its place, 2 feet 7 inches above the banking floor. Deceased had often changed the rails. He ought to have had the cage in such a position that he could not have fallen into the pit. He fell 435 yards.
