When deceased and his mates arrived at their working place they found that a bar and its two supporting legs had been displaced by a fall of shale from the roof. Deceased was clearing the shale preparatory to re-setting one of the legs when a further fall of roof struck him across the back. He died the next day of Toxaemia. The men should have set temporary roof supports before beginning to work.
