- Deceased was engaged in building a pack on the side of a road where a width of 10 feet of coal was being taken out and replaced by an 8-feet pack, when a fall of roof occurred, killing him almost instantly. No timber or supports were displaced by the fall, bit at the commencement of the shift a prop was burst out causing a small fall. In contravention of Section 49 deceased was working under a roof not made secure, and the specified distance for setting supports was exceeded. The place had been inspected by a deputy 4 hours before the accident and reported safe.
