Deceased was about to fill an accumulation of dust into a tram on a haulage road dipping 3 ins. per yard. His empty tram, with three sprags in the wheels was left by the haulier a few yards above the accumulation of dust. Deceased asked the haulier if he might slacken the sprags, run the tram down to where it was wanted, and commence filling. The haulier told him not to do so, but in his absence deceased evidently removed one sprag and started the tram down the dip. He failed to control it and was crushed between it and the next stationary tram on the dip.
