He was hewing in a gateway in a seam 2 feet 6 inches thick when a large stone fell from the roof and killed him. He had been warned by the deputy to set additional props as he worked the coal out as the top was bad. This he neglected to do and worked beyond the liberal maximum timber distance of 6 feet. This accident should not have occurred.
