- He was hewing along with another man in old pillar workings with a bad roof which required careful and close timbering, and owing to the clayey nature of the roof balks were used and a 2 feet timbering distance was in force. The deputy had not been gone more than 20 minutes when a fall of stone occurred and canted out the last two balks which had only middle props under them. The fall caught the deceased as he was filling a tub. If these balks had been ended, as they should have been, according to the timbering rules, the accident would not have occurred.
