- Deceased was at work on the night shift at the small coal picking-belt which is enclosed and at a high elevation from the ground floor. During an interval while the pricking-belt was at rest, deceased left the belt to go to the mess-room. He descended the ladder provided and was making his way across the metals and passed between the buffers of waggons that were only slightly apart at the moment when the shunter was lowering four empties which stood 10 yards above. The shunter had gone past the place, but would not see the deceased who came from the opposite side. There was a 64 c.p. electric lamp, besides several 32 c.p., close to the place. There was a level crossing to the mess-room by which deceased ought to have travelled.
