- A tramway from the quarry extends about 300 yards to a refuse tip. Deceased’s father had contracted with the Quarry Company to provide a horse and driver on this tramway and had sent his son. There is first a slight decline from the quarry then a slight ascent, and then a decline to the tip. At the crown a man from the tip met the wagon, which was an end tip contractor’s wagon, inserted a sprag and took it to the tip. A large stone, weighing from 2 to 3 tons, with greasy surfaces, had been loaded on to the wagon, and deceased took it away with the horse, and the man from the tip met it at the crown and inserted a sprag in one of the hind wheels and deceased was uncoupling the horse’s chain from the wagon when the stone appears to have moved forward, tipped up the body of the wagon, broken off the door and fallen on to the tramway, pinning deceased below it. He was released in a few minutes, but died an hour afterwards.
