Whilst working in the quarry he was struck by a fall of overburden which broke his left thigh, drove his ribs into his lungs, injured his heart, and caused death the same day. He had so worked out the stone in his part of the quarry as to undermine the overburden, instead of him removing the overburden from the top and subsequently working out the stone. He contracted to get out so much stone and to remove the overburden, but apparently his methods were not supervised in any way by the occupiers of the quarry or by their surveyor.
