- He was timbering on a coal cutter face preparatory to the coal cutter following on. While in the act of cutting a hole in the coal to receive a balk end a large triangular piece of stone fell from between breakers on to him and killed him. The maximum timbering distance for the seam was 5 feet, but the area from which the stone fell (9 feet by 6 feet) was not supported. His death was the result of his neglect in not observing the timbering Rules.
