- A shaft, 8 feet in diameter, had been sunk 22 yards from the face of a hard heading driven through a fault. It had proved the coal, and very little remained to be done in it. Deceased and his mates were sitting at the top of the shaft, eating their food, when the chargeman, who was some distance away called deceased. He got up and walked quickly towards the chargeman, and right into the shaft, having evidently forgotten it. The opening at the top of the shaft was 34 inches square and should have been fenced.
