Deceased and his marrow were working in a broken working eight yards wide which was loose at both sides and nearly holed. Whilst listening to hear if the putter was coming a triangular shaped piece of stone suddenly fell away from two slips between the face and the tub and caught deceased. The place was timbered well within the timbering distance, which was four feet, except under the area where the stone fell and there should certainly have been two sets of gears under this point.
