- Deceased was walking along the main haulage road to his work with another dataller named Foulds, when a bump occurred and some rock came away from a joint in the roof above them and knocked them both down Foulds received a cut on the head but Gabbitas was fatally injured. The road is in strong ground and no timber was used to support the roof.
