He was removing a balk of timber from the framework of a hoist used for raising stone from the bottom of the quarry when the ladder upon which he was standing broke and he was precipitated to the bottom of the hoist a distance of about 45 feet. The ladder had been burnt nearly through one of the side staves. This was known to deceased, but he had not reported the defect to the owners.
