Deceased was starting a place to the rise off an old road in robbery workings in Yeowarts Dip fist in the Yard band of No.4 pit, and had only taken out a foot or two of coal when the fall took place. The seam is 6 feet thick and is overlaid by a foot of softish stone known as ‘fallen.’ This stone fell for a length of 16 feet and a breadth of 4 feet close off by the coal face, canting out five or six props in its fall and covering deceased. It was relieved by a slip next to the coal and an irregular parting above. The place was examined by a deputy before work started but deceased and another hewer, who worked near him, were not satisfied that it was safe and sent for another deputy who came and put up two or three props and this deputy was past the place again before the accident. The undermanager also visited deceased about 3.5 hours before the accident. There was plenty of loose timber near.
