A hole was bored and charged with gelignite two months prior to the accident and it did not explode, part of the stemming was withdrawn and an additional cartridge inserted and fired but this failed to explode the original charge. While at work taking off stones in the vicinity of the shot the charge was discovered and deceased struck part of it with his pick causing an explosion. Immediately before explosion some of the cartridges were taken from the hole and were hard.
