- Contrary to instructions, he and his partner were preparing to run a pile of stuff from the top of a stull at the back of the 364 fathoms level east of new sump shaft. They knocked a hole through the covering boards of the stull to enable them to place a charge of dynamite between the loose rocks. Floyd was standing on a spreader which was fixed underneath and was in the act of preparing a cavity in which to insert the explosive, when suddenly a huge quantity of stuff fell on him and killed him instantly. Apparently in preparing for the shot they disturbed the pile, probably by dislodging a key stone, and so caused the mass to surge. A week previous to the accident the "taker" of the "pare" asked the captain to give them permission to run the stull and was refused pending an examination of the place by the captain, with a view to his instructing them how to proceed. The "taker" had informed Flood’s partner of this. The partner was subsequently prosecuted, convicted and fined for contravention of Special Rule 94.
