Deceased was taking an empty tram down a dip heading and must have omitted to see that the pointers of the stalls were properly set, as the horse turned into a low rubbish stall, on which horse traffic was not permitted and knocked out two pairs of timber with the result that a fall occurred which killed horse and haulier.
