Deceased was, with his horse, taking a tram of coal out of a stall, when it got off the rails at the mouth. He and two colliers tried to lift it on with the aid of a pull from the horse. The horse, however, refused to pull, so deceased left the tram and went towards the horse, which then pulled vigorously. The tram got on the rails at the pointers and the horse would not stop. Deceased was walking between it and the tram when his foot caught and he fell and was run over. He died on November 18.
